The Muslim Marriage and Divorce (Amendment) Act, No. 24 of 2013 (Sri Lanka)
Abstract
The Muslim Marriage and Divorce (Amendment) Act, No. 24 of 2013, enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka, introduces reforms to the legal framework governing marriage and divorce within the Muslim community. The Act seeks to modernize and address certain inequalities present in the original 1951 legislation, particularly concerning the rights of women in marriage and divorce.
Key amendments focus on improving the legal standing of Muslim women by ensuring greater fairness in divorce proceedings and increasing protections against unfair treatment. The Act introduces provisions for the registration of Muslim marriages and divorces, ensuring greater transparency and legal recognition. It also strengthens the role of the Quazi (Islamic judge) in overseeing matrimonial disputes, requiring more rigorous training and accountability. The age of marriage for Muslim women is also addressed, aligning more closely with national standards to prevent child marriages and protect young girls.
