Abstract
Before discussing the subject, first let us see the definition of rape. As per I.P.C. Section 375, 376 A.B.C.D., rape is counted as a severe crime, cognisable, nonbailable, liable for five to ten years imprisonment and fine and the case can be filed only in the Sessions Court of a First Class Magistrate. But the main hindrance is that it is extremely difficult to prove that 'consent' was not given by the victim, this being the main criterion in proving rape cases.
